Ad Deletion

hyway99 reserves the right to delete any ad without notification or refund if, in our opinion, appears fraudulent (scam) or does not comply with our terms as set out below. hyway99 is a local classifieds website, therefore ads will also be deleted (at our discretion) without notification or refund if they involve any kind of money transfers or shipping of a product.

Acceptance of Terms

hyway99 provides various online resources that enable users to post and browse classified ads, view advertisements, and e-mail posters. These services are subject to the following terms of use. By using our services, you are agreeing with hyway99's terms of use.

Using hyway99

By using our services, you agree and abide by the following rules:

• Do not post false or misleading ads.
• Do not post, email or make available content that is harmful, offensive, unlawful, abusive, defamatory, libelous, invasive of another's privacy, or is harmful to minors in any way.
• Do not post ads that contain any kind of illegal activity or substance that is prohibited or restricted by any applicable law.
• Do not copy other users' information and use them without their consent.
• Do not violate any Canadian law.
• Do not post spam
• Do not start or participate in pyramid schemes.
• Do not infringe any third-party right.
• Do not distribute any form of computer virus, code or programs that may interfere with hyway99's functionality or any type of technological equipment.
• Do not harass other users.
• Do not post the same ad in the same category more than once or in any other category where it is not appropriate.

Fees

The use of the following hyway99 services is free:

• Posting ads
• Replying to ads
• Posting messages in the online forum
• Viewing content in ad and forum sections

hyway99 may charge a fee to parties interested in a premium service such as featuring an ad in the Featured Ads section. Fees are in Canadian Dollars and are subject to change. These fees are non-refundable and must be transacted and received by hyway99 before the advertisement is featured in the site.

Content

You agree that all postings (including messages, photos and any type of content) transmitted through hyway99 are the sole responsibility of the user from whom such content originated. You, the user, are responsible for the content that you post on the site. You acknowledge that hyway99 does not pre-screen or approve content posted or emailed in the website, but that hyway99 reserves the right to refuse, delete or move any content where we have grounds of suspecting the violation of these terms or of any party's rights. Though we prohibit users from posting false, misleading, offensive or explicit information, you still may be exposed to such contents. Further, hyway99 and content available through the site may contain links to other websites, which are independent of hyway99. Lastly, you agree not to copy, modify or distribute hyway99's copyrights and trademarks.

Reporting Inappropriate Conduct

If you find any posted material false, misleading, offensive, explicit or in violation of hyway99's Terms of Use , e-mail us at info@hyway99.ca explaining why you feel the said material is problematic. hyway99 reserves the right to decide whether said material is inappropriate or problematic and complies with these Terms of Use. hyway99 may remove such material and/or terminate a user's access for uploading such material in violation of these Terms of Use at any time, without prior notice and at its sole discretion.

hyway99 will terminate a user's access to its website if, under appropriate circumstances, they are determined to be a repeat infringer.

Liability

You agree that hyway99 is not to be held responsible for the content of postings made by its users. Though these postings and material are transmitted through hyway99, we do not guarantee the accuracy, reliability, quality, safety, or legality of the product or service being posted and advertised by users. We are not liable for any loss, whether of money (including profit), goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of hyway99, even if you advise us or we reasonably foresee the possibility of any such damage occurring. Some jurisdictions do not allow the disclaimer of implied warranties. In such jurisdictions, some of the foregoing disclaimers may not apply to you insofar as they relate to implied warranties.

Limitations on Service

You acknowledge that hyway99 may establish limits concerning use of the service, including the maximum number of days that content will be retained by the service, the maximum number and size of postings, email messages, or other content that may be transmitted or stored by the service, and the frequency with which you may access the service. You agree that hyway99 has no responsibility or liability for the deletion or failure to store any content maintained or transmitted by the service. You acknowledge that hyway99 reserves the right at any time to modify or discontinue the service with or without notice, and that hyway99 shall not be liable to you or to any third party for any modification, suspension or discontinuance of the service.

Disclaimer of Warranties

You agree that use of the hyway99 service is entirely at your own risk. The hyway99 site and service is provided on an "as is" or "as available" basis, without any warranties of any kind. To the fullest extent permitted by law, hyway99 disclaims any warranties for the security, reliability, timeliness, accuracy, and performance of the hyway99 site and the service. To the extent legally allowed, hyway99 disclaims any warranties for other services or goods received through or advertised on the hyway99 site, or accessed through any links on the hyway99 site.

Personal Information

When you use hyway99's site and services, you agree to the collection, transfer, storage and use of your personal information by hyway99 on servers located in Canada and/or USA.

General

The Terms of Use constitute the entire agreement between you and hyway99 and govern your use of the hyway99 service, superceding any prior agreements between you and hyway99. The Terms of Use and the relationship between you and hyway99 shall be governed by the laws of Canada without regard to its conflict of law provisions. The failure of hyway99 to exercise or enforce any right or provision of the Terms of Use shall not constitute a waiver of such right or provision. If any provision of the Terms of Use is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the terms remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the Terms of Use must be filed within one (1) year after such claim or cause of action arose or be forever barred.
